Who is Responsible if a Tree Falls on my Property?

If the tree is on your property, you are responsible for its clearance. Homeowners' insurance will likely cover any costs of clean-up and damage to your property, sheds, fences or other structures, but these policies generally won't cover a tree that's fallen because you haven't cared for it properly or because an unskilled person has tried to remove it. You may still need to bear part of the costs depending on the terms of your cover.

If a tree on your neighbour's property falls on your shared fence, the responsibility shifts to them.

If a tree on public land falls on your property and causes damage, the council is responsible for clean-up and any removal costs. Your homeowners' insurance would bear the costs of damage to your property, fences, sheds and structures, however...

The responsibility shifts to you when a tree on your land falls.

If the tree was healthy and has caused damage, and you have home and contents insurance, you'll be covered - but if the tree is considered unhealthy or tends to drop branches you will end up bearing the costs regardless of your insurance.
